Olivier is an accomplished litigator who represents businesses and individuals in New Jersey state and federal court disputes, including chancery and appellate matters, as well as in arbitration and mediation proceedings.

He provides strategic advocacy to protect his clients’ commercial interests in business litigation, with experience encompassing breach of contract claims, business torts, closely held business and partnership disputes, and real estate and construction matters.

Olivier’s broad-based experience includes litigation involving professional liability, breach of fiduciary duty, mismanagement, theft of trade secrets, and minority shareholder and oppressed shareholder cases.

He handles equitable claims that require sophisticated legal responses, including the representation of individuals in contested trust and estate matters. He is also an experienced appellate practitioner at both the state and federal levels, and is equally adept in alternative dispute resolution, frequently representing clients in high-value arbitrations and mediations.

Representative Matters

  • Represented film and Broadway producer Marty Richards in litigation in the New Jersey trial court, Appellate Division, and Supreme Court establishing his status as a beneficiary of a 1961 Charitable Lead Trust valued at approximately $300–$350 million. Secured rulings at all levels confirming the client’s entitlement to trust distributions as a surviving spouse.
  • Played an integral role in the firm’s successful defense of Top 25 accounting firm against claims of professional malpractice before the New Jersey Appellate Division.
  • Represented the co-founder, President, CEO, and 50% shareholder of a prominent emergency physician group in litigation against the other 50% owner seeking injunctive relief, oppressed shareholder remedies, and damages for fraud, breach of fiduciary duty, breach of loyalty, and mismanagement.
  • Represented the developer of the retail component of a ground-up mixed-use project in Essex County in a seven-day arbitration against the residential developer concerning disputes over construction general conditions and soft costs.
  • Represented a 25% owner of multiple related small businesses in litigation against principal owners alleging, among other claims, violations of the New Jersey Oppressed Shareholder Statute.
  • Represented an accounting firm in litigation against a former employee alleging breach of the duty of loyalty, unfair competition, theft of confidential information, and violations of the New Jersey Computer-Related Offenses Act.
  • Represented three business entities and four family member principals in an eight-year dispute involving litigation, mediation, and arbitration against a fifth family member, including claims for partition by sale, breach of fiduciary duty, and mismanagement of family properties and businesses.
  • Represented a leading U.S. hotel developer in litigation against an architect and multiple contractors arising from the rehabilitation and renovation of a first-class hotel property in Somerset County.
  • Represented one of the nation’s largest personal training providers in litigation brought by a gym owner alleging business tort claims.
  • Negotiated a favorable settlement on behalf of a registered home improvement contractor in litigation asserting claims under the New Jersey Consumer Fraud Act.
  • Secured dismissal, following jurisdictional discovery, of two corporate owners of a nursing home in litigation alleging violations of the New Jersey Nursing Home and Rights of Residents Act, negligence, gross negligence, and wrongful death.
  • Represented a New Jersey company in defending against a multinational corporation’s trade secret misappropriation lawsuit, successfully barring certain claims through motion practice.
  • Assisted in representing a member of a real estate development corporation in fiduciary duty and oppression litigation involving a Morristown redevelopment project, uncovering concealed valuation discrepancies and securing a $6.6 million settlement consisting of $4 million in cash and real property valued at $2.6 million.
