When an insurance company denies a claim or disputes its coverage obligations, a company can be blindsided by the denial of coverage. Greenbaum’s insurance coverage team helps policyholders navigate these complex disputes, with experience that encompasses a broad range of first-party and third-party insurance coverage disputes. We assist clients in reviewing and interpreting the coverage provided by their policies and provide assistance throughout the claims process, negotiating with insurers to secure the maximum level of coverage.

When insurance coverage litigation becomes unavoidable, we represent clients in lawsuits to obtain coverage involving property, construction, environmental and product issues, and under a variety of policy types including commercial general liability (CGL), directors and officers (D&O), and errors & omissions (E&O) policies. We represent clients – including builders and developers, healthcare providers, real estate firms, and companies facing environmental issues – in a wide variety of insurance coverage matters.

Representative Matters

  • Advised a general contractor on emergent insurance coverage strategy following a catastrophic crane accident at a New York City high-rise project, mitigating exposure stemming from an uninsured and insolvent subcontractor and addressing tens of millions of dollars in project delay losses.
  • Successfully negotiated the elimination of redundant seven-figure insurance coverage obligations for a carrier client, reducing exposure despite an adverse trial-court ruling requiring concurrent coverage under multiple policies.  
  • Served as associate counsel to a court-appointed Special Master overseeing pretrial proceedings in a complex insurance coverage dispute exceeding $100 million, including management of discovery disputes and preparation of a report and recommendations on a dispositive motion adopted in full by the federal district court.
